Distance Sales Agreement and Pre-Contract Information

1. Parties

SELLER: İNOSLAB VENTURES YAZILIM HİZMETLERİ LİMİTED ŞİRKETİ, registered office at Bulgurlu Mah. Bağcılar Cad. E Blok Detay 1 Sitesi No: 18 AD, Üsküdar, İstanbul, Türkiye (hereinafter the SELLER). BUYER: the user whose name / company name, address and email are stated in the account details at the time of the order (hereinafter the BUYER). Store URL: https://www.presidentsmsg.com

2. Subject

This agreement sets out the rights and obligations of the parties under the Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation regarding the sale and performance of the digital service (subscription plan or email sending credits) ordered electronically by the BUYER on the SELLER's website https://www.presidentsmsg.com, whose features and price are stated in the order summary.

3. Service features and price

  • Service: The selected plan (Starter / Pro / Enterprise) or credit amount; monthly sending quota, recipient list limit and additional features are stated on the plan page and in the order summary.
  • Price: Prices are listed in USD. For buyers in Turkey the TRY amount is calculated at the current exchange rate at the time of payment and shown on the payment page including VAT.
  • Invoice: After payment confirmation an e-Archive / e-Invoice is issued and sent to the BUYER's registered email address; it can also be downloaded from the account panel.

4. Payment

Payments can be made by credit / debit card (via PayTR and other licensed payment institutions, with installment options on eligible cards) or by wire transfer / EFT. Card details are not stored by the SELLER; payment is processed on the secure infrastructure of the licensed payment institution. With the BUYER's consent, a card stored at the payment institution is used for subscription renewals.

5. Delivery

The service is digital and involves no physical delivery. It is activated on the BUYER's account immediately upon confirmation for card payments and within 1 business day after the payment receipt is submitted for wire transfer / EFT. Details are on the Delivery and Shipping Terms page.

6. Right of withdrawal

The BUYER may withdraw from the agreement within 14 days without giving any reason and without penalty, provided that performance of the service has not started. The withdrawal notice is sent in writing to support@presidentsmsg.com or via the support form in the account panel.

Under Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for services whose performance has started with the BUYER's approval and for intangible goods delivered instantly in electronic form. This exception applies once the plan or credits activated on the account start to be used; partial-use and refund conditions are set out on the Cancellation and Refund Terms page.

7. Subscription term, renewal and cancellation

Subscriptions are purchased for the selected term (monthly or yearly) and renew automatically on the same terms at the end of the term unless cancelled by the BUYER. The BUYER may stop renewal at any time from the account panel or via support; cancellation takes effect at the end of the current term and the service remains available until then.

8. General provisions

  • The BUYER declares having read and accepted this pre-contract information, the Acceptable Use Policy and the Privacy Policy before placing the order.
  • The SELLER provides the service within the availability targets stated on the SLA page.
  • The agreement is concluded when the BUYER confirms the order electronically and is stored electronically by the SELLER.

9. Dispute resolution

Disputes arising from this agreement are resolved by the Consumer Arbitration Committees at the BUYER's place of residence or the SELLER's location within the monetary limits announced annually by the Ministry of Trade, and by the Consumer Courts above those limits. For business buyers the Istanbul (Anatolian) Courts and Enforcement Offices have jurisdiction.

10. Entry into force

By confirming this agreement at the payment step the BUYER is deemed to have accepted all terms. The agreement enters into force upon completion of payment.
